what will be the Legal position of sent parcel,

Hi all,
please let me know what will be legal position of those parcels,

I have sent two parcels to a client in Italy worth of both parcels were
1480 euro, custom of my country has cleared and sent both parcels to the client in Italy,
I asked several times are these parcel reach with him but after a long period he replied that parcels are with their custom officials and they are demanding some documents for its release,
on this i lodged a complain in my local post office from where parcel were sent , after 15 days they sent me a official latter that both parcels are delivered to the person concerned, but he has not replied me ,as in these days there was a real problem with Italian custom and my two more parcels were returned undelivered from Italy, same person has demanded me more insects care off his a friend living an other country and i send him parcel on his given address till six months he tell me that his friend has still not sent insects to him , finally he tell me that he has received insects from his friend but mostly insects are broken and i will think to pay you some money worth of this parcel was about 500 euro,
after that he has not replied my any email,

Question is that when parcel was cleared from my country,
and the postal official has confirmed its delivery officially ( such latter and EMS receipts is available in my record) then is not his l morality responsibility, to pay my money,
moreover , third parcel he has excepted delivery after 8 months why he is not sending its price,

2, A Parcel was sent to Spain worth 955 us$, on web tracking Number show its delivery, while postal official has also confirmed delivery but client is not responding me ,
what i have to do
may i have to put all detail with photocopies here on net,

These persons has to pay for what they have ordered.

Hi Rehman,

I think the legal status of your parcels is...stolen.

I agree with the others - the "buyers" have an absolute moral responsibility to pay for the items they ordered...as well as a legal responsibility.

The problem is going to be getting anyone from any official body "interested" in pursuing matters. I can't imagine the Italian or Spanish Police investigating matters even if you contacted/emailed them to report the theft.

I'd say your best bet is to provide full details of the buyers, plus scans of delivery notes etc, online here (in the Insect Trading Reports section) so that other sellers can avoid these people.

Appears as though you have been stolen from. In a nutshell: The buyer is responsible for having his or her permits in order to receive them in his or her country. The seller is responsible for any permits from the country of origin. Many insect sellers on Ebay clearly state that they are not responsible for customs hold ups and will not return money if the destination country takes the shipment. I hate being stolen from. I wish I believed in Karma...

As I am honest insect dealer and have good reputation I rely on that.I have many good customers that trust me.
I only ship parcels after receiving payment , then I send parcel registered airmail with confirmed delivery .
I never have complaints from my customers .
I have to work like this because a few times in the past I have been ripped off by customers, I get some rare material from time to time and it is irreplacable , they say never got the parcel , but I know they did receive the parcel .
Some are private people and one a well known insect dealer in England who ripped me off and has never ever bothered to contact me again , I look at it his loss in the long run as he never gets another insect from me.
As a sender not only is it your responsibility to have all customs clearance from your country , BUT , you also have to ask your customer to make sure he is allowed to import and there is no restriction .Some people can tell you its OK to import but it is not , they take the gamble on your specimens , if they get through is all goodd , but if problems re import they will be the first to blame you and say I won`t pay for what I don`t get , so better make all checks first .

When I worked as a diver and collected species for pet stores and aquariums, I used to contact those who ripped off my boss and tell them that the shipment they did not pay for was forgiven and that I would continue to sell to them but payment would have to occur first. Oddly, those who had ripped off my boss never ordered again because they figured they would get ripped off. We had no intention of doing so because we would rather have had a frequent customer. I appears that, to them, instant small profit was better than long term "fortune." So - no honor among thieves. I am sorry that you were treated so poorly rehmanzeemi. I wish I believed in Karmic justice.

please give me the name of your italian customer. It is not the first time I read that "Many Ebay sellers- not just insects- will not sell to Italy because of the rampant fraud", and really I do not like this situation, as I am italian.
I can not promise I will solve your problem, but I will try.
